Paris Olympics Action to Ban QR Codes Fails

A request filed before the Council of State attempted to counter the future platform which will set up QR Codes to circulate in Paris during the Olympic Games. But the administrative body rejected the action, considered premature.

It is from May 10, 2024 that the registration platform to travel in certain areas of Paris during the Summer Olympic Games will be open. From this site, the public will be able to obtain a digital pass, in the form of a QR Code. The system, mentioned in November, was clarified in April by the Minister of the Interior, Gérald Darmanin.

Possession of this QR Code will have a significant impact on traffic during the Paris Olympics. Access to certain areas in the city will be subject to the presentation of supporting documents and acceptance of certain security procedures — such as pat-downs and searches of bags and luggage to attend the events.

Three weeks before its opening, the platform remains relatively vague. However, this does not prevent an opposition from being put in place before the courts. As just picked it up public law specialist Nicolas Hervieu, an action before the Council of State was launched on April 16 with the aim of countering this future site.

Too early action before the courts

The procedure was initiated by two groups classified on the extreme right of the political spectrum: Les Patriotes of Florian Philippot, a former member of the National Rally party, and Via la chemin du peuple, founded by Christine Boutin. A request which, however, ended on April 18, by a rejection of the Council of State.

The highest administrative court considered that the action of the two movements was hasty. In its decision, the administrative body notes that the minister's announcement ” has not given rise to the intervention of any administrative act defining the modalities according to which such a platform will be implemented “.

In other words, at the time of the order of the Council of State, there was no particular legal act to examine to determine its proportionality and its legality with regard to the fundamental freedoms which would be endangered, eyes of the applicant associations. We will have to wait for the publication of any administrative act to contest it.

A second justification was also provided by the institution, this time on the choice of method. Both parties referred the matter to the summary judge, which allows for an urgent decision – unlike cases handled on the merits. An unfounded approach in the eyes of the administrative jurisdiction, because the urgency is not obvious.

Even assuming that a decision in principle has been taken, the condition of particular urgency (…) cannot be considered in this case as fulfilled “, we read in the decision. If the implementation of the platform is planned for May 10, 2024, the use of QR Codes is planned much later, a week before the Olympics, which begin on July 26.
