How can the balance be achieved between compensating rights holders and granting developers access to data?

Following a self-referral and a public consultation, the Competition Authority has just issued this June 28 his opinion on generative artificial intelligence. A concept which designates “AI models capable of creating new content which can for example be text, images, sound or videos“.

Offer bundled data access offers

In order to “promote the competitive dynamics of the sector“, the independent administrative authority formulates a series of recommendations, one of which concerns access to data by model developers in order to “guarantee their capacity for innovation. It therefore recommends that public authorities, and more particularly the Ministry of Culture, encourage rights holders such as content publishers to take into account the economic value of data according to use cases (for example by introducing prices differentiated) and to propose “bundled offers“reducing transaction costs.
