Data from genetic tests sold in kits on the Internet are not only personal. They are “multi-personal“ because “they are transmissible and shared“. Indeed, they are linked to the DNA of its carrier but also shared in part by several people. Hence the need to be particularly careful, according to the National Commission for Information Technology and Liberties (Cnil ) who has just published a document on this topic.
Tests banned in France
It is important to specify that the penal code prohibits the purchase of a recreational genetic test under penalty of a fine of 3,750 euros. Companies that offer this type of service are liable to 15,000 euros and one year in prison. Indeed, the conditions for genetic analyzes in France are very strict. They can only be carried out if the test has been requested by a doctor, for therapeutic purposes. A judge can also request it as part of a paternity search, as can the police for the purposes of a criminal investigation.
